(B. Braun) has entered into a settlement agreement in the amount of $14.7 million with the Department of Justice to resolve a long-standing dispute relating to pricing information published by third parties for certain pharmaceutical products manufactured by B. Braun. The matter was part of an industry-wide investigation arising out of a qui tam action filed under seal in the Southern District of Florida in 1995 by Ven-a-Care of the Florida Keys against B. Braun's predecessor in interest, McGaw, Inc.

  Company Wins Case Against Terumo Corporation for its Introcan Safety^® IV Catheter Patent
  Bethlehem, PA — November 23, 2010 — Germany-based medical device manufacturer B. Braun Melsungen AG and its U.S. subsidiary B. Braun Medical Inc. (B. Braun) announced today that the company prevailed in a patent infringement suit against Japan's Terumo Corporation and its U.S. subsidiary Terumo Medical Corporation. The verdict was awarded by the U.S. District Court for the District of Delaware, confirming the validity of an infringed claim of B. Braun's 2007 patent (U.S. Patent 7,264,613) for its Introcan Safety^® IV Catheter.

• B. Braun Voluntarily Recalls Seven Lots of Heparin Manufactured in 2008 due to Supplier-Initiated Recall of Heparin Active Pharmaceutical Ingredient (API)
  Irvine, CA — October 27, 2010 — B. Braun Medical Inc. (B. Braun) was recently notified by its supplier, Scientific Protein Laboratories LLC (SPL), of a nationwide recall of a lot of Heparin Sodium USP Active Pharmaceutical Ingredient (API) sold to B. Braun because additional testing of retained crude heparin samples used by SPL to manufacture this single API lot indicated a trace amount of oversulfated chondroitin sulfate (OSCS) contaminant. As a result, B. Braun is initiating a voluntary recall of seven lots of heparin injection products to the healthcare provider level. These lots were manufactured in 2008 and will be expiring on October 31, 2010 and November 30, 2010.
